Senators Graham, Blumenthal, Hawley, and Feinstein Introduce EARN IT Act to Combat Child Sexual Expl


On Thursday, Senate Judiciary Committee Chairman Lindsey Graham (R-SC) along with Ranking Member Feinstein (D-CA) and Senators Blumenthal (D-CT) and Hawley (R-MO) introduced the Eliminating Abusive and Rampant Neglect of Interactive Technologies Act (EARN IT Act). The bill would amend section 230 of the Communications Decency Act to create incentives for companies to “earn” liability protection for violations of laws related to online child sexual abuse material (CSAM). Furthermore, the bill establishes a ‘National Commission on Online Child Sexual Exploitation Prevention’ to recommend best practices related to identifying and reporting online child sexual exploitation. The EARN IT act also bolsters enforcement of child sexual abuse material statutes and allows survivors civil recourse if companies do not adhere to the established list of reasonable best practices.
